DMCA Copyright Policy

Alaha Technology LLC (“we,” “us,” or “our”) respects the intellectual property rights of others and expects users of KnanayaCommunity.org and the Knanaya Community Mobile Application (collectively, the “Site”) to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, we have adopted the following policy regarding copyright infringement.

If you believe that any content on the Site infringes upon your copyright, please follow the procedure outlined below to submit a notice of claimed infringement.

Filing a Takedown Notice (Copyright Holders)

If you are a copyright owner, or authorized to act on behalf of one, and you believe that content on the Site infringes your copyright, you may submit a written DMCA takedown notice to our Designated Agent as a document file to the contact form. To be effective under the DMCA, your notice must include all of the following:

  1. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works at a single online site are covered by a single notification, provide a representative list of such works.
  2. Identification of the material claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Site (e.g., a URL or specific description of where the content appears).
  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  4. A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

Upon receipt of a valid and complete takedown notice, we will expeditiously remove or disable access to the allegedly infringing content and notify the user who posted the content.


Filing a Counter-Notice (Affected Users)

If you believe that content you posted on the Site was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notice to our Designated Agent as a document file to the contact form. Your counter-notice must include all of the following:

  1. Identification of the material that was removed or disabled, and the location where the material appeared before it was removed or disabled (e.g., the URL).
  2. Your full legal name, mailing address, telephone number, and email address.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Dallas County, Texas, if your address is outside of the United States), and that you will accept service of process from the person who provided the original takedown notice.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original complainant who submitted the takedown notice. If the original complainant does not notify us within ten (10) business days that they have filed a court action to restrain the allegedly infringing activity, we may, at our sole discretion, restore the removed content.


Repeat Infringer Policy

In accordance with the DMCA and applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed repeat copyright infringers. We may also, at our sole discretion, limit access to the Site or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.


Safe Harbor Notice

KnanayaCommunity.org is a community platform that hosts user-generated content. We do not pre-screen content submitted by users. We qualify for the “safe harbor” protections under 17 U.S.C. § 512 because we act expeditiously to remove infringing content upon receipt of a valid takedown notice, do not receive a financial benefit directly attributable to the infringing activity, and do not have actual knowledge of the infringing content prior to notification.


False Notices

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees. We reserve the right to seek such damages from any party who submits a fraudulent or bad-faith notice.


Modifications to This Policy

We reserve the right to modify this DMCA Copyright Policy at any time. Changes will become effective upon posting of the revised policy on the Site, with the “Last Updated” date reflecting the most recent revision. Continued use of the Site following such changes constitutes your acceptance of the updated policy.
